Yung Filly to Face Retrial Over Three Unresolved Rape Charges in Australia
British YouTuber and rapper Yung Filly is set to face a retrial in Western Australia after a jury was unable to reach verdicts on three rape charges arising from an alleged incident involving a 20-year-old woman in Perth in September 2024.
Yung Filly, whose real name is Andrés Felipe Valencia Barrientos, underwent an eight-day trial at the District Court of Western Australia in July. The jury considered six charges of sexual penetration without consent, alongside allegations of assault and choking.
The jury acquitted Barrientos of three of the rape charges and found him not guilty of choking and one assault charge. However, jurors could not reach the required majority verdict on the remaining three rape charges.
Prosecutors Confirm Retrial
On Friday, prosecutors confirmed that they intend to bring Barrientos back before the court for a retrial on the three unresolved rape charges.
The woman involved in the case, who cannot legally be identified, has agreed to give evidence again, according to prosecutors. The judge has asked lawyers on both sides to consider whether the retrial should be heard before a jury or by a judge sitting alone.
A retrial does not mean that Barrientos has been found guilty of the outstanding allegations. The three charges remain unresolved, and he continues to be entitled to the presumption of innocence unless and until a court determines otherwise.
Assault Convictions
Although Barrientos was cleared of several allegations, the previous trial did result in convictions on two counts of assault occasioning bodily harm.
Those convictions related to allegations that he bit the woman, with the prosecution presenting photographs showing injuries and bruising. Barrientos acknowledged biting her during his evidence but maintained that the sexual encounter was consensual and described the bites as “love bites”.
Sentencing for the two assault convictions is expected to take place after the retrial.
What Happens Next?
Barrientos remains on bail and is expected to return to court as the Australian legal process continues. A further hearing is scheduled to deal with his bail conditions, while another court appearance is expected to address the listing of the retrial.
The case has attracted significant public attention because of Barrientos’ profile as a British entertainer and social-media personality. However, the retrial will concern only the three rape charges on which the original jury was unable to reach a verdict.
The outcome of those proceedings will determine whether Barrientos is convicted or acquitted of the remaining allegations.
