TRUMP ORDERED TO TESTIFY UNDER OATH IN $10 BILLION BBC LAWSUIT

US JUDGE SETS DECEMBER 11 DEADLINE — PRESIDENT RISKS HAVING HIS OWN CASE DISMISSED IF HE FAILS TO COMPLY

By 222 News | 24 October 2026

US President Donald Trump has been ordered to answer questions under oath in his $10 billion (£approximately 7.5 billion) lawsuit against the BBC, following a court dispute over the timing of his testimony.

A US magistrate judge, Enjolique Lett, issued the order during a hearing in Miami on Thursday, 22 October 2026. Trump must attend a legal deposition by 11 December 2026, unless the court changes the timetable. Failure to comply could result in sanctions, potentially including the dismissal of his lawsuit. WHY IS TRUMP SUING THE BBC?

The legal battle centres on a BBC Panorama documentary titled Trump: A Second Chance, which featured edited excerpts from Trump’s speech on 6 January 2021, shortly before his supporters stormed the US Capitol.

Trump alleges that the programme misleadingly combined separate parts of his speech, creating the impression that he directly encouraged violence at the Capitol. He filed the lawsuit in Florida in December 2025, seeking at least $5 billion in damages on each of two claims.

The BBC has acknowledged that the editing created a misleading impression and apologised. However, the broadcaster denies that the programme amounted to legally actionable defamation and is seeking to have the case dismissed. The allegations have yet to be resolved by the court.

COURT CLASH OVER MISSED TESTIMONY

Trump had been scheduled to give a deposition on 16 October but cancelled the appearance, citing matters of national importance.

The BBC’s lawyers challenged the delay, arguing that Trump had attended political events in Georgia and a fundraiser at his Mar-a-Lago property in Florida on the same day.

Trump’s legal team disputed the suggestion that he was deliberately avoiding testimony and argued that his presidential responsibilities and security requirements affected scheduling.

His lawyers proposed dates in January 2027, but the BBC argued that this would be too late because the evidence-gathering phase of the case is due to conclude on 18 December 2026.

Judge Lett ordered Trump to sit for questioning by 11 December unless the court’s timetable is formally extended. She also allowed the deposition to be video-recorded for use by the lawyers, rather than released publicly. BBC News

WHAT HAPPENS NEXT?

The upcoming deposition could give the BBC’s legal team an opportunity to question Trump about his allegations, the harm he claims the documentary caused and the damages he is seeking.

The BBC is also pursuing financial information relating to membership applications and fees at Trump’s Mar-a-Lago club, arguing that the records could help assess issues connected to reputation and damages. Trump’s lawyers have challenged the relevance of some of the broadcaster’s requests.

The judge’s deadline is a significant procedural development, but it does not mean Trump has lost the case. Equally, the BBC’s apology does not by itself establish legal liability.

THE BOTTOM LINE

Trump’s $10 billion lawsuit now faces an important deadline as both sides prepare their arguments. His sworn testimony could become a key part of the legal proceedings, while the BBC continues to contest the claim.

The central question remains whether Trump can establish the legal grounds for his claims and prove that the broadcaster is liable for the damages he seeks. No final decision on the lawsuit has been announced.
